July 30, 2026 — NASHVILLE, Tenn. —The Future of Free Speech has submitted comments to the Federal Trade Commission, warning that a proposed policy statement on “suppression of accuracy in AI systems” would violate the First Amendment.
The filing responds to an FTC notice seeking public comment on whether prohibitions on deceptive acts or practices in Section 5 of the Federal Trade Commission Act can apply to companies that market AI systems.
The organization’s filing argues the proposal would make the government the arbiter of truth when it comes to AI-generated speech. It also argues that conditioning liability on whether AI outputs reflect undefined “ideological objectives” would transform the FTC into a speech regulator.
“The Statement condemns state efforts to dictate AI outputs, then claims that very power for the federal government,” said Ashkhen Kazaryan, Senior Legal Fellow at The Future of Free Speech and author of the filing. “The First Amendment does not permit any agency to police the ideology of speech, and a precedent set today will be inherited by every administration that follows.”
