January 15, 2025 — NASHVILLE, Tenn. — Today, the Supreme Court [upheld, overturned, delayed] the law that would ban TikTok in the United States. The Future of Free Speech, a nonpartisan think tank that recently submitted an amicus brief to the court in this case, has issued the following statement in response.

Statement from Jacob Mchangama, Executive Director:

“Today marks a significant setback for the First Amendment and a disheartening blow to the millions of Americans who rely on TikTok to express themselves, share ideas, and engage with their communities. By failing to apply the most rigorous constitutional scrutiny to this sweeping ban, the Supreme Court has allowed a law with profound implications for free expression to stand.

“This decision sets a dangerous precedent that could embolden Congress to further restrict online speech under the guise of national security. It will also make it more difficult for the United States to challenge the increasing number of censorial speech regulations targeting U.S.-based platforms in other countries. Free speech advocates must now redouble their efforts to prevent this precedent from undermining the robust protections guaranteed by the First Amendment.”
